Landlord claims deli owes $30K in back rent

GRAFTON – A Taylor County landlord is suing a tenant to recover nearly $30,000 in allegedly unpaid rent.

Clarksburg-Terrace Plaza 1989 Limited Partnership filed a lawsuit May 23 in Taylor Circuit Court against Hank’s Deli LLC, Earl Henry Soutter and Matthew Sturm, alleging breach of a lease agreement.


According to the complaint, the defendants signed a lease with Clarksburg-Terrace on Aug. 7, 2009, agreeing to pay $3,000 in monthly rent for the first five years of the contract. The contract contained a clause allowing Hank’s Deli to extend the lease for the next six to 10 years at $3,300 per month.

However, the suit says the lease fell into arrears beginning in July 2011, now totaling $28,989 in unpaid back rent. Clarksburg-Terrace alleges that Soutter and Sturm personally guaranteed all amounts due under the lease.

The plaintiff seeks $28,989 in damages. It is represented by attorney Jerred P. Roth of Burton Neil & Associates PC in West Chester, Pennsylvania.
