Tenant accuses landlord, maintenance crew of negligence over alleged injury

BECKLEY – A Raleigh County woman says she was struck by a pipe while leaving her apartment, an accident allegedly caused by negligent maintenance workers.

Nashala Ann Sydenstricker filed a lawsuit May 23 in Raleigh Circuit Court against Maxwell & Keyser Inc., Tamayo Realty LLC, Tony Campagna and Terry Bragg, alleging negligence.


According to the complaint, Tamayo Realty hired Maxwell & Keyser to make plumbing repairs on its Virginia Street building in September of 2014. The suit says that on Sept. 9, 2014, as Sydenstricker entered a stairwell, she was struck by a pipe falling from the repair area. The plaintiff claims there were no warning signs or barricades denoting the hazardous area. She suffered knee and foot injuries, incurred medical expenses, and suffers from limited mobility in her knee, the suit claims.

Sydenstricker seeks a jury trial, punitive and compensatory damages, interest and legal fees. She is represented by attorney Kyle G. Lusk of Lusk & Bradford PLLC in Beckley.
