FAYETTEVILLE — A patron is suing Whitewater Bar & Grill LLC, operator of a hotel/motel and restaurant, alleging negligence, failure to warn and insufficient measures taken to prevent injuries.
Bonnie Bevins filed a complaint on June 2 in Fayette Circuit Court against Whitewater Bar & Grill LLC, alleging that the business failed to provide a safe way for patrons to walk from the hotel/motel to the restaurant.
According to the complaint, the plaintiff alleges that on July 25, 2015, she her family were overnight guests at defendant's hotel/motel in Fayetteville. While traversing the defendant's parking lot on their way to the restaurant, she allegedly fell because of a defect in the lot, causing her to sustain injuries to her hand, arm and shoulder, both temporary and permanent in nature. The plaintiff holds Whitewater Bar & Grill LLC responsible because the defendant allegedly failed to repair defects in its parking lot and failed to install signage or other markings warning about the defect.
The plaintiff requests a trial by jury and seeks judgement against defendant for compensation for all damages, costs of this action, prejudgement interest and such other and further relief as the court deems just and proper. She is represented by Robert R. Kuenzel of Kuenzel & Associates PLLC in Chapmanville.
