LOGAN — A woman who is the administrator of her deceased husband's estate is suing Fortner Logging LLC and Fortner Tree Trimming Inc., alleging wrongful death.
Miranda Wykle, administrator of the estate of Randy Dale Wykle Jr., filed a complaint on June 10 in Logan Circuit Court against the defendants, alleging that they carelessly failed to provide a safe place to work.
According to the complaint, the plaintiff alleges that on June 13, 2014, Randy Dale Wykle Jr. was directed by his supervisor to cut down large trees on a job site at the Beech Branch Tract in Logan County when a spring pole dislodged and struck him, causing him to sustain fatal injuries. The plaintiff holds the defendants responsible for the death because they allegedly failed to provide adequate safety equipment, failed to provide proper training and supervision and failed to inspect the work site to assure proper and safe procedures and conditions.
The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages, punitive damages, attorney fees and costs, pre- and post-judgment interest and for any other relief the court deems just and proper.
