WHEELING — A property owner is suing Marshall County residents Peter A. Miller and Jennifer Miller, doing business as JLM Enterprises LLC, alleging negligence and insufficient measures taken to prevent damages.
Karen McKean filed a complaint on June 10 in Ohio Circuit Court against the defendants, alleging that they breached their duty by letting a tree become unsafe.
According to the complaint, the plaintiff alleges that on Dec. 24, 2014, an unstable tree from the defendants' property fell on the plaintiff's house, causing property damage, annoyance, inconvenience and loss of use. The plaintiff holds the defendants responsible because they allegedly refused and failed to maintain, trim, or remove the tree, thereby allowing it to become dangerously unstable, rotten and unsafe.
The plaintiff requests a trial by jury and seeks an award against the defendants for compensatory damages, annoyance, inconvenience, loss of use, punitive damages, litigation expenses, court costs, pre- and post-judgment interest and all other relief that the court may fairly award.
