BECKLEY — Two Raleigh County residents are suing William E. Wilkerson and Ean Holdings LLC, a car rental company and its agent, alleging negligence and insufficient measures taken to prevent injuries.
Leonard Abrams and Robin Abrams filed a complaint on June 7 in Raleigh Circuit Court against the defendants, alleging that Wilkerson failed to comply with traffic rules and regulations.
According to the complaint, the plaintiffs allege that on June 12, 2014, while Leonard Abrams was driving a 2013 Ford cargo van in Beckley, Wilkerson made an improper turn into oncoming traffic and caused a collision. Leonard Abrams allegedly suffered severe bodily injuries and Robin Abrams is claiming loss of companionship.
The plaintiffs hold the defendants responsible over allegations of driving the vehicle into and against traffic, failing to use due care, failing to keep the vehicle under control, failing to keep proper lookout and operating the vehicle at excessive speed.
The plaintiffs request a trial by jury and seek judgment against defendants for an amount to be determined at trial plus interest, punitive damages, attorney's fees and costs, and such other relief as the court deems appropriate.
