Woman sues Lowe's Home Center over alleged contract breach

BECKLEY — A homeowner is suing Lowe's Home Center LLC, a home improvement company, citing alleged breach of contract, breach of implied warranty, intentional infliction of emotional distress and negligence.

Teresa Daniel filed a complaint on June 8 in Raleigh Circuit Court against Lowe's Home Center LLC, alleging that the home improvement company violated the Consumer Credit and Protection Act.

According to the complaint, the plaintiff alleges that on July 10, 2015, she entered into a contract with the defendant to repair her kitchen and laundry area. On September 7, 2015, the defendant tore off the roof and asked for additional $5,600 before the contractor could continue the repair, leaving her home exposed to the elements, the suit says. During the work delay, her home was struck with torrential rain that caused substantial damage, she alleges, adding that to date, her home has never been fully completed. The plaintiff holds Lowe's Home Center LLC responsible because the defendant allegedly failed to complete the home improvement work per contract and refused to complete the drip edge and guttering and clean up and repair her kitchen.

The plaintiff requests a trial by jury and seeks judgment against the defendant for actual damages or an amount necessary for the repairs, including the complete renovation of the kitchen and laundry area, and her costs incurred herein, pre- and post-judgment interest and attorney's fees. She is represented by Paul W. Roop II of Roop Law Office in Beckley.
