Two lawsuits accuse W.Va. PECU of breach of contract

Contract 03

LOGAN – Two lawsuits have been filed against the West Virginia Public Employees Credit Union after the plaintiffs’ claim the credit union breached its contract.

On March 21, 2014, and March 25, 2014, the defendant filed a civil complaint against Kristina Goodman and on July 10, 2013, the defendant filed a civil complaint against James E. Akers, in an effort to collect debts owed by the plaintiffs, according to two complaints filed June 14 in Logan Circuit Court.

Goodman and Akers claim the complaints in Logan Magistrate Court failed to assert each of the necessary statutory requirements of West Virginia code for the commencement of civil actions and engaged in unfair or unconscionable means to collect or attempt to collect on a claim.

The defendant’s conduct is unfair and/or deceptive, against public policy and violates the Constitution of West Virginia and the United States, according to the suits.

The plaintiffs claim the defendant owed a duty to them to refrain from violating the laws of the state of West Virginia and the Constitution of West Virginia and the United States.

The defendants breached their duty and the plaintiffs suffered because of the defendants’ breach, according to the suits.

The plaintiffs claim the defendant was negligent and caused them to suffer damages.

The plaintiffs are seeking compensatory and punitive damages. They are being represented by Steven S. Wolfe and J. Christopher White of Wolfe, White & Associates.

Logan Circuit Court case number: 16-C-127, 16-C-129
