On Jan. 14, 2015, the defendant filed a civil complaint against Melissa Cyfers and Melvin Cyfers in Logan Magistrate Court in an effort to collect on a consumer debt they owed, according to two complaints filed June 14 in Logan Circuit Court.
The Cyferses claim the complaint in Magistrate Court failed to assert each of the necessary statutory requirements of West Virginia code for the commencement of civil actions and engaged in unfair or unconscionable means to collect or attempt to collect on a claim.
The defendant’s conduct is unfair and/or deceptive, against public policy and violates the Constitution of West Virginia and the United States, according to the suits.
The Cyferses claim the defendant owed a duty to the plaintiffs to refrain from violating the laws of the state of West Virginia and the Constitution of West Virginia and the United States.
The defendants breached their duty and the Cyferses suffered because of the defendants’ breach, according to the suits.
The Cyferses claim the defendant was negligent and caused them to suffer damages.
The Cyferses are seeking compensatory and punitive damages. They are being represented by Steven S. Wolfe and J. Christopher White of Wolfe, White & Associates.
