PRINCETON — A customer is suing Macado's Inc. and Macado's of Blumfield LLC, a restaurant operator, citing alleged breach of duty, failure to warn, and insufficient measures taken to prevent injuries.
Vickie Monk filed a complaint on June 13 in Mercer Circuit Court against the defendants, alleging that they breached their duty to maintain their floor in a safe and reasonable condition.
According to the complaint, the plaintiff alleges that, on July 22, 2014, she was a customer at the defendants' restaurant located at Mercer Mall in Mercer County. As she was exiting the building after a meal, she slipped on a slippery substance on the floor, causing her to fell down stairs and suffer injuries. As a direct and proximate result, she has suffered physical pain and suffering, physical limitations and diminished capacity to enjoy life, and has incurred medical expenses, the suit says. The plaintiff holds the defendants responsible because they allegedly permitted the floor to have a hazardous and unsafe condition, created an unreasonable risk to the public and failed to employ appropriate measures to ensure the safety of the public.
The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages, punitive damages, pre- and post-judgment interest, attorneys' fees and expenses and such other relief as the court deems just and proper.
