Creditor claims bills unpaid

WHEELING — A creditor is suing Ohio Valley Fabrication & Energy Services Inc. and Taflan Steel & Welding Inc., debtor and guarantor respectively, citing alleged breach of contract and failure to pay for delivered goods.

O'Neal Steel Inc. filed a complaint on June 13 in Ohio Circuit Court against the defendants, alleging that they violated their credit application and guaranty agreement.

According to the complaint, the plaintiff alleges that it has suffered monetary damages for not collecting payments for the delivered goods in the amount of $31,996.15, excluding interest. The plaintiff holds the defendants responsible because they allegedly have failed to pay the amount due.

The plaintiff requests a trial by jury and seeks judgment against defendants for $31,996.15, together with interest charged at the agreed rate of 18 percent per annum from February 11, together with actual attorney's fees of $4.799.42, cost of suit and all other relief to which it is entitled. It is represented by John R. Keating of Amato, Keating and Lessa PC in Bethlehem.
