Landscape supplier says construction firm owes money

WHEELING — A landscape supplier is suing APS Construction & Consulting Inc. and James M. Taylor and Heather A. Taylor, citing alleged breach of contract, failure to pay for purchased products and unjust enrichment.

Morelli Brothers Block & Brick Co. Inc. filed a complaint on June 13 in Ohio Circuit Court against the defendants, alleging that they failed to comply with the terms of an agreement.

According to the complaint, the plaintiff alleges that it has suffered monetary damages for not receiving payment for the balance of $7,552.92. The plaintiff holds the defendants responsible because the defendants allegedly failed and refused to perform material provisions of the contract and failed to pay the agreed price in full.

The plaintiff requests a trial by jury and seeks judgment against defendant in the amount of $7,552.92, plus interest and costs and for such other relief as the court deems meet and proper. It is represented by Daniel J. Guida of Guida Law Offices in Weirton.
