Doctor accused of failing to diagnose cancer

BECKLEY — A couple's lawsuit against Ralph E. Simms, D.O., a medical doctor, cites alleged negligence.

Sherry Fraley and Roger Fraley filed a complaint on June 16 in Raleigh Circuit Court against Simms, alleging that the  doctor negligently failed to recognize, diagnose, threat or refer plaintiff Sherry Fraley to an appropriate specialist.

According to the complaint, the plaintiffs allege that, on January 7, 2010, and continuing thereafter, the defendant negligently cared for Sherry Fraley due to a sore throat. Over the course of months, the defendant continued to prescribe antibiotics to her, not considering or recognizing the possibility of cancer, the suit says. Finally in May 2014, she was seen by another physician, and she was diagnosed with throat cancer and had to undergo radiation and chemotherapy, the suit alleges. As a result, she will continue to suffer pain and mental anguish, disfigurement, medical expenses, loss wages, humiliation and embarrassment, the plaintiffs claim. The plaintiffs holds Simms responsible because the defendant allegedly failed to timely and appropriately recognize the possibility of cancer and failed to properly and timely provide critical medical care and treatment.

The plaintiffs request a trial by jury and seek judgment against the defendant for compensatory damages, punitive damages, pre- and post-judgment interest and such other relief as they may be entitled. They are represented by Stacy A. Jacques and Richard D. Lindsay of Tabor Lindsay & Associates in Charleston.
