Woman sues Bone & Joint Surgeons for negligence

CHARLESTON – A woman is suing Bone & Joint Surgeons after she claims a podiatrist was negligent and caused her damages.

Dr. Carrie P. Gosselink was also named as a defendant in the suit.

In July 2013, Carolinda J. Cutlip was having difficulty with her feet, including bunions, bunionettes and bunion deformities, according to a complaint filed June 21 in Kanawha Circuit Court.

Cutlip saw Gosselink from July 30, 2013, through March 25, 2014, and during her treatment, Gosselink performed three surgical procedures on her, which endd up resulting in permanent deformity to both of her feet, impairing her ability to walk and function.

As a result of the treatment rendered by Gosselink, the plaintiff sought a second opinion and had to have repair surgeries to correct the deformities and to allow her to function somewhat, although not fully, according to the suit.

Cutlip claims as a result of the surgeries performed by Gosselink, she sustained severe and permanent physical and mental injuries, including amputation and fusions.

The defendants had a duty to provide the level of podiatric care to the plaintiff as would a reasonably prudent podiatrist practicing under the same or similar circumstances, according to the suit.

Cutlip claims the defendants breached their duty by failing to provide the level of podiatric care expected of a reasonably prudent podiatrist practicing under the same or similar circumstances and were otherwise negligent.

Cutlip is seeking compensatory damages. She is being represented by Michael J. Del Giudice of Ciccarello, Del Giudice & LaFon.

The case is assigned to Circuit Judge Carrie Webster.
