Woman sues grocery operators over fall

CHARLESTON — A woman is suing KRGP Inc. and Kroger Limited Partnership I, alleging that negligence was responsible for her fall at a grocery store.

Teresa Brooks filed a complaint on June 6 in Kanawha Circuit Court against the defendants, alleging that they failed to exercise their duty of care to maintain the store premises in a reasonably safe condition.

According to the complaint, the plaintiff alleges that on June 14, 2014, she was a business invitee at the defendants' store when she fell and sustained personal injuries, causing her to suffer damages including lost wages and earning capacity, physical pain and mental anguish, loss of enjoyment of life and medical expenses. The plaintiff holds the defendants responsible because they allegedly failed to discover and eliminate a dangerous and unsafe condition on the pathway within the store premises.

The plaintiff requests a trial by jury and seeks judgment against the defendants to compensate her loss and damages in an amount not to exceed $75,000, cost and expenses and for such other relief that may may be proper. She is represented by Henry R. Glass III of Glass Law Offices in South Charleston.
