Man says negligence in medical care led to amputation

Medical malpractice 03

WHEELING — A man is suing Cary D. Amundson, M.D. and Wheeling Hospital Inc., alleging that negligence following an ankle sprain eventually led to amputation of his leg below the knee.Dan R. Hoffman Sr. filed a complaint on June 23, in the Ohio Circuit Court against the defendants, alleging that failure to properly treat a sprained ankle and ensuing complications led to amputation of the leg below the knee.

According to the complaint, the plaintiff alleges that after being treated for a March 14, 2014 sprain, he developed bullous cellulitis and necrosis leading to amputation. He holds the defendants responsible for allegedly failing to order consultative evaluation and examination, failing to recognize the serious risk of infection, failing to provide detailed instructions and failing to provide care, treatment and management in discharging him with an imminent danger of infectious disease and potentially life-threatening illness.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount to be determined by a jury, compensatory damages, pre- and post-judgment interest and costs and such other relief deemed just and fair. He is represented by C. Richard Wilson of Wilson Law Offices in Moundsville and Wesley W. Matheney of Wilson, Frame and Matheney PLLC in Morgantown.
