Woman blames golf cart owners for injuries

Law money 06

KINGWOOD — A woman is suing Stephanie L. Mott and Sheena Zbosnik, golf cart owners, citing alleged failure to warn, negligence and insufficient measures taken to prevent injuries.

Jennifer Hunt filed a complaint on June 21 in Preston Circuit Court against the defendants, alleging that they failed to operate the golf cart in a reasonable and safe manner.

According to the complaint, the plaintiff alleges that on June 28, 2014, while she was on the back seat of the defendants' golf cart being operated by Zbosnik, Zbosnik applied the accelerator in a way that caused the cart to lurch forward and eject the plaintiff from the cart, leading to a fracture to the distal radius of her left arm and shoulder, physical pain and mental anguish, lost wages and medical expenses. The plaintiff holds the defendants responsible because they allegedly modified their golf cart to give it more power than it should have, and failed to warn her that the golf cart would lurch forward when the accelerator was applied.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount that will fairly compensate her for her injuries and losses, pre- and post-judgment interest, attorney fees, costs of the action and such other relief as the court may deem fit and proper. She is represented by Kelly R. Reed and Tamara B. Williamson of Law Offices of Kelly R. Reed PLLC in Morgantown.
