Customer says he was injured due to defective sidewalk

FAYETTEVILLE — A man is suing Mountaineer Mart Inc., a grocery store owner, alleging failure to take measures to prevent injuries.

David Crockett Hutchison filed a complaint on June 29 in Fayette Circuit Court against Mountaineer Mart Inc. alleging that the grocery store owner failed to exercise reasonable care in preventing harm to its invitees.

According to the complaint, the plaintiff alleges that on May 3, he visited the defendant's store to make a purchase. As he approached the store's entrance, he says, he slipped, tripped and fell due a defective sidewalk, suffering injuries to his knee, wrist, back and leg. The plaintiff holds Mountaineer Mart Inc. responsible because the defendant allegedly improperly maintained the defective sidewalk and failed to warn invitees of the dangerous conditions.

The plaintiff requests a trial by jury and seeks compensation for damages suffered, pre- and post-judgment interest, attorney fees, costs and such other relief that the court deems just and proper. He is represented by Kyle G. Lusk and Matthew A. Braford of Lusk & Bradford PLLC in Beckley.
