Pair claim violation of agreement on right of way, easements

MOUNDSVILLE — A married couple's lawsuit against Cone Gathering LLC and Cone Midstream Devco I LP, Delaware companies, cites alleged breach of contract.

John R. Gray and Kara L. Gray filed a complaint on June 27 in Marshall Circuit Court against the defendants, alleging that they violated a right-of-way and easement agreement.

According to the complaint, the plaintiffs allege that they suffered damages because a 25-foot gap between two easements becomes worthless. The plaintiffs holds Cone Gathering LLC and Cone Midstream Devco I LP responsible because the defendants allegedly installed a valve with a manhole cover, failed to restore the area properly and failed to pay the agreed $80 per linear foot of slope distance.

The plaintiffs request a trial by jury and seek declaratory relief along with all compensatory and punitive damages, attorney fees and expenses and all other relief as the court deems appropriate. They are represented by Frank X. Duff of Schrader Byrd & Companion PLLC in Wheeling.
