Pennsylvania company accuses Noble Energy of misappropriation

CLARKSBURG — A Pennsylvania company is suing Noble Energy Inc., a natural gas exploration company, citing alleged conversion and unjust enrichment.

JJK Mineral Company LLC filed a complaint on July 8 in the U.S. District Court for the Northern District of West Virginia against Noble Energy Inc., alleging that the natural gas exploration company failed to pay for natural gas extracted and sold.

According to the complaint, the plaintiff alleges that since April 13, 2010, it has suffered and will continue to suffer damages unless and until the court has rendered a decision in its favor. The plaintiff holds Noble Energy Inc. responsible because the defendant allegedly drilled a series of Marcellus shale horizontal natural gas wells on and around the plaintiff's property despite being aware that the plaintiff owns the property, and has failed to make payment for any of the natural gas it has extracted and sold.

The plaintiff requests a trial by jury and seeks an order requiring the defendant to make a full accounting to the plaintiff of all natural gas extracted from the Nancy Sargent tract and sold since April 13, 2010. It is represented by James A Walls, Matthew P. Heiskell and Joseph V. Schaeffer of Spilman Thomas & Battle PLLC in Morgantown.
