HUNTINGTON — A passenger is suing Tri-State Transit Authority, a bus company, alleging that insufficient measures were taken to prevent injuries.

Shannon Leigh Thomison filed a complaint on June 23 in Cabell Circuit Court against Tri-State Transit Authority, alleging that the bus company breached its duty to protect its passengers from harm.

According to the complaint, the plaintiff alleges that on June 23, 2014, while was exiting at the back of a bus, she was unaware that the back was not lowered and when she stepped off the bus, her ankle popped throwing her to the pavement, causing her to suffer injuries that resulted in physical pain, mental suffering, annoyance, aggravation and inconvenience. The plaintiff holds Tri-State Transit Authority responsible because the defendant allegedly failed to give proper warning to passengers at the back, failed to place a proper warning sign, and failed to exercise its duty of ordinary care.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of the jurisdictional limits of the court plus pre- and post-judgment interest. She is represented by Donald R. Jarrell of Law Offices of Donald R. Jarrell in Wayne.
