Property owner claims XTO Energy breached contract

FAYETTEVILLE — A property owner is suing XTO Energy Inc., a lessee, citing alleged breach of contract.

Harewood Properties LLC filed a complaint on July 5 in Fayette Circuit Court against XTO Energy Inc. alleging that the lessee failed to comply with the First Revised Meter Site Lease Agreement.

According to the complaint, the plaintiff alleges that it entered into a lease agreement with the defendant effective Jan. 1, 2013 and set to end Dec. 31, 2021. It allegedly has been damaged for not receiving rental payment beginning in 2016. The plaintiff holds XTO Energy Inc. responsible because the defendant allegedly failed to pay any rental for 2016.

The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of $10,000 in past due rentals, $95,200 for future rentals, attorney's fees, pre-judgment interest and such other relief as the court may deem appropriate. It is represented by Paul O. Clay Jr. of Paul Clay Law in Fayetteville.
