Laboratory company seeks payment for services

WINFIELD — A laboratory company has filed a class-action lawsuit against Trinity Coal Corporation and Frasure Creek Mining LLC, a coal mining company, citing alleged breach of contract.

Ma Inc., f/k/a Bio-Chem Testing Inc., filed a complaint on July 8 in Putnam Circuit Court against the defendants, alleging that the coal mining operations failed to abide by the terms of a promissory note and security agreement.

According to the complaint, the plaintiff alleges that throughout the year 2015 and early 2016, it rendered services on behalf of the defendants in Putnam County in the amount of $215,595. The plaintiff holds the defendants responsible because they allegedly refused to pay for services the plaintiff provided.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount sufficient to compensate its outstanding debt owed, plus interest, costs and attorney's fees. It is represented by Thomas H. Peyton of Peyton Law Firm PLLC in Nitro.
