Consumer sues debt collector over alleged law violation

WAYNE — A consumer has filed a class-action lawsuit against Resurgent Capital Services LP, a debt collector, citing alleged unlawful collection practices.

Roy C. Clark filed a complaint on June 24 in Wayne Circuit Court against Resurgent Capital Services LP, alleging that the debt collector violated the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on Aug. 17, 2015, he began receiving collection letters from the defendant, seeking to collect a debt he allegedly owed to Lowe's. Despite disputing the validity of the debt and requesting cessation of further efforts to collect the debt, he continued to receive collection letters, causing him to suffer damages. The plaintiff holds the defendant responsible because the company allegedly continuously sent collection letters even after being informed that the alleged debt was time barred and gave false and misleading information.

The plaintiff requests a trial by jury and seeks compensation for statutory damages, plus attorney's fees, costs and expenses. He is represented by J. William St. Clair of Legal Aid of West Virginia in Huntington.
