WEST UNION — A leasehold owner is suing Atlas Enameling Company, New Cornelia Extension Copper Corp., United Exploration Company et. al., working interest owners, citing alleged breach of contract.
Antero Resources Corporation filed a complaint on July 5 in Doddridge Circuit Court against the defendants, alleging that they failed to fulfill their obligations set forth per the original assignments and subject lease.
According to the complaint, the plaintiff alleges that it has suffered damages, including but not limited to the defendants' proportionate share in the development of the Marcellus Shale formation underlying the subject property. The plaintiff holds the defendants responsible because they allegedly voluntarily relinquished control and possession of their interest, refused to pay their proportionate share of expenses and failed to participate in the development of the subject property.
The plaintiff requests a trial by jury and seeks declaration that the defendants' contract is canceled, termination of defendants' proportionate share of the profits from production of the subject property, and pre-judgment and post-judgment interest.
