BECKLEY — A consumer has filed a class-action lawsuit against General Motors LLC, a car manufacturer, citing alleged breach of warranty.
Nolen C. Hodges filed a complaint on July 1 in Raleigh Circuit Court against General Motors LLC, alleging that the car manufacturer violated the West Virginia Code.
According to the complaint, the plaintiff alleges that on May 6, 2015, he purchased a new 2015 Chevrolet Silverado from the defendant's dealer. After the purchase, he experienced nonconformities with the vehicle warranty, which substantially impaired its use and market value, the suit alleges. He was caused to suffer loss of use of the vehicle, annoyance, inconvenience and expenses for replacement transportation, according to the claim. The plaintiff holds General Motors LLC responsible because the defendant allegedly failed to conform the new vehicle to the warranty and failed and refused to replace the vehicle with a comparable new one.
The plaintiff requests a trial by jury and seeks revocation of acceptance and refund of the purchase price, compensation for damages, attorney's fees and other relief as the court deems appropriate. He is represented by Anthony M. Salvatore of Hewitt & Salvatore PLLC in Beckley.
