HUNTINGTON — A consumer has filed a complaint against Synchrony Bank, f/k/a GE Capital Retail Bank, a debt collector, citing alleged fraudulent filing of information returns.
Marian Henry filed a complaint on July 5 in the U.S. District Court for the Southern District of West Virginia Huntington Division against the defendant, alleging that the debt collector failed to comply with the terms of their settlement agreement.
According to the complaint, the plaintiff alleges that she suffered damages by paying penalties for failure to file interest on her unpaid taxes. The plaintiff holds the defendant responsible because it allegedly has assessed her settlement amount twice, willfully filed a fraudulent information with the IRS and refused to correct the mistake when the matter was brought to its attention.
The plaintiff requests a trial by jury and seeks judgment against the defendant for all damages, costs of litigation, attorneys' fees, and such other relief as the court deems fair and equitable. She is represented by Daniel K. Armstrong and Benjamin K. Sheridan of Klein & Sheridan LC in Hurricane.
