BECKLEY — A customer is suing Homesure Services Inc., a warranty plan provider, citing alleged breach of contract.
Deborah Davis filed a complaint on July 7 in Raleigh Circuit Court against Homesure Services Inc. alleging that the warranty plan provider violated the West Virginia Code.
According to the complaint, the plaintiff alleges that on May 11, 2015, her heating and air conditioning unit quit working. Due to the defendant's delays, she says, she sought assistance from another technician to inspect the unit, and the defendant's actions and inactions allegedly caused her to suffer damages for loss of use of her heating/air conditioning unit. The plaintiff holds Homesure Services Inc. responsible because the defendant allegedly denied her claim due to another technician diagnosing the problem, failed to acknowledge the claims arising under the insurance policy and refused to pay claims.
The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, attorney's fees, costs and such other relief as the court may deem appropriate. She is represented by Paul W. Roop II of Roop Law Office LC in Beckley.
