PHILIPPI — A customer is suing Family Dollar Stores of West Virginia Inc., a retail store operator, alleging that insufficient measures were taken to prevent injuries.
James W. Welch filed a complaint on July 11 in Barbour Circuit Court against Family Dollar Stores of West Virginia Inc. alleging that the retail store operator failed to provide a reasonably safe facility.
According to the complaint, the plaintiff alleges that on Jan. 24, while he was shopping at the defendant's store in Philippi, he slipped on a wet floor and fell, causing a laceration to his head that required an emergency room visit and approximately seven staples to repair. The incident caused him to suffer pain, embarrassment and medical expenses, he claims. The plaintiff holds Family Dollar Stores of West Virginia Inc. responsible because the defendant allegedly failed to maintain, inspect and exercise reasonable care on the premises, and failed to correct the dangerous condition.
The plaintiff requests a trial by jury and seeks judgment against the defendant for all damages, post-judgment interest, attorney's fees, expenses and such additional relief as the court may deem just and proper. He is represented by Michael A. Jacks of Jacks Legal Group PLLC in Morgantown.
