Ally Financial accused of harassment in collecting alleged debt from couple

PINEVILLE – A Stephenson couple claims a bank repeatedly harassed them over an alleged debt.

Ivan Combs and Angela Combs filed a complaint on July 12 in Wyoming Circuit Court against Ally Financial Inc., formerly known as GMAC Inc., alleging that the debt collector violated the West Virginia Consumer Credit and Protection Act and other counts.

According to the complaint, the plaintiffs allege that they suffered unreasonable harassment, oppression, abuse, aggravation, annoyance, inconvenience, stress and worrying due to the defendant's actions. The plaintiffs hold Ally Financial Inc. responsible because the defendant allegedly continued to harass them in an attempt to collect a debt after it was notified that the plaintiffs were being represented by counsel.

The plaintiffs request a trial by jury and seek compensatory, statutory and punitive damages, interest, costs and attorney fees, and any sum awarded of more than $74,999. They are represented by Troy N. Giatras of The Giatras Law Firm PLLC in Charleston.
