Woman seeks to stop Reverse Mortgage Solutions from foreclosing on house

BECKLEY – A Beckley woman seeks to enjoin a foreclosure on her late mother's house.

Dianna S. Morris filed a complaint on June 28 in Raleigh Circuit Court against Reverse Mortgage Solutions Inc. alleging violation of the West Virginia Consumer Credit and Protection Act.

According to the complaint, the plaintiff alleges that she and her son live in the house that was owned by late mother, Daisel Morris, who she helped care for until her death in November 2015. The suit states that defendant has a contract for a reverse mortgage on the home with the plaintiff's late mother, which the plaintiff knew nothing about until the defendant contacted Daisel Morris' estate. The defendant claims it is owed $38,000 under the contract or it will foreclose the property and sell it.

The plaintiff requests a trial by jury and seeks compensation for actual and compensatory damages, to enjoin the foreclosure, attorney fees and costs and such other relief as she may be entitled. She is represented by Gary M. Smith of Mountain State Justice Inc. in Charleston. The case has been assigned to Circuit Judge H.L. Kirkpatrick III.
