LOGAN – A fuel provider alleges a Roderfield company has not paid for fuel.
Mountain State Petroleum Inc. filed a complaint on July 13 in Logan Circuit Court against Vanover Trucking Inc. alleging breach of contract and unjust enrichment.
According to the complaint, the plaintiff alleges that it has suffered damages for not receiving payment for the fuel it supplied to defendant's drivers between June 2015 and July 2015, for the total amount of $10,595.37, including finance charges. The plaintiff holds Vanover Trucking Inc. responsible because the defendant allegedly failed to pay its obligations under the agreement.
The plaintiff requests a trial by jury and seeks judgment against defendant in an amount of $10,595.37. It is represented by Arnold J. Janicker and Steven P. Turner of Jenkins Fenstermaker PLLC in Huntington. The case has been assigned to Circuit Judge Eric H. O'Briant.
