MOUNDSVILLE – A Benwood teen and her mother have filed a suit after the teen was injured in an all-terrain vehicle accident.
Aubree L. Williams, a minor, by Tracy A. Graham, her mother and legal guardian, filed a complaint on July 18 in Marshall Circuit Court against Tyler Kirkland; Thru Tubing Solutions Inc.; Colin Buzzard; Charles Buzzard and Cherie Buzzard, individually and as parents, guardians and next friend of Colin Buzzard, a minor; and Carrie Mason alleging negligence, negligent supervision and other counts.
According to the complaint, the plaintiff alleges that on Aug. 1, 2014, she was a guest at defendant Mason's home in Moundsville and boarded an all-terrain vehicle operated by Colin Buzzard, 15 at the time, that was owned by his parents Charles and Cherie Buzzard. While traveling southbound on Noble Access Road, the suit states the all-terrain vehicle collided with a truck, owned by Thru Tubing and operated by Kirkland, causing Williams to sustain life-threatening injuries, damages and harm.
The plaintiff holds Kirkland; Thru Tubing Solutions Inc.; Colin Buzzard; Charles Buzzard and Cherie Buzzard, individually and as parents, guardians and next friend of Colin Buzzard, a minor; and Mason responsible because the defendant vehicle operators allegedly negligently and carelessly operated their vehicles, failed to keep proper lookout while driving, negligently entrusting Colin buzzard with the operation of the vehicle, and other counts.
The plaintiff requests a trial by jury and seeks judgment against defendants jointly and severally, in an amount sufficient for her injuries, pre- and post-judgment interest, costs and such other relief as the court deems just and proper.
