Man claims Marlette Funding LLC made harassing phone calls to collect alleged debt

CHARLESTON – A consumer is accusing a debt collector of telephone harassment.

Jeffrey Warren filed a complaint on July 7 in the U.S. District Court for the Southern District of West Virginia against Marlette Funding LLC alleging violation of the West Virginia Consumer Credit and Protection Act and the Telephone Consumer Protection Act and other counts.

According to the complaint, the plaintiff alleges that the defendant's unlawful collection practices caused him to suffer damages and be bothered, annoyed, upset, angered, inconvenienced, abused and/or oppressed. The plaintiff holds Marlette Funding LLC responsible because the defendant allegedly engaged in oppressive and abusive conduct in attempting to collect a purported debt by continuing to call him even after he requested it to stop and made calls using an electronic communication device.

The plaintiff requests a trial by jury and seeks compensation for all damages, costs of litigation, attorney's fees and such other relief as the court shall deem just and proper. He is represented by Daniel Armstrong and Benjamin Sheridan of Klein & Sheridan LC in Hurricane.
