Driver alleges she was injured in accident in Moundsville

MOUNDSVILLE – A motorist has filed suit against another driver and his employer after an accident on Second Street.

Diane E. O'Connor filed a complaint on July 14 in Marshall Circuit Court against Klug Bros. Inc. and Davis L. McVicker alleging negligence.

According to the complaint, the plaintiff alleges that on July 28, 2014, she was driving westbound on Second Street in Moundsville when she was struck by a vehicle owned by defendant Klug Bros. and operated by McVicker. She alleges the incident caused her to sustain serious injuries that caused her to incur medical related expenses. The plaintiff holds Klug Bros. Inc. and McVicker responsible because defendant McVicker allegedly failed to yield right of way, failed to take necessary measures to avoid the collision and failed to use ordinary care.

The plaintiff requests a trial by jury and seeks judgment against defendants jointly and severally in an amount deemed just and equitable, attorney's fees and costs and such other relief as the court should find. She is represented by Christopher M. Turak of Gold, Khourey & Turak LC in Moundsville. The case has been assigned to Circuit Judge Jeffrey Cramer.
