Financing company claims violation of guaranty agreement

WINFIELD — A financing company is suing Rock Branch Mechanical Inc., James B. Clark and James Brandon Clark, debtor and guarantors, citing alleged breach of agreement.

Branch Banking & Trust Company filed a complaint on July 18 in Putnam Circuit Court against the defendants, alleging that they failed to comply with a guaranty agreement.

According to the complaint, the plaintiff alleges that it has suffered monetary damages for not receiving payment in an amount of $749,280.26. The plaintiff holds the defendants responsible because they allegedly have been in default for failing to make monthly payments.

The plaintiff requests a trial by jury and seeks judgment against the defendants in the principal amount of $749,280.26, plus interest, court costs and attorney's fees and such other relief to which it may be entitled. It is represented by W. Scott Stinnett of Lloyd & McDaniel PLC in Louisville, Kentucky.
