Woman says mortgage loan servicer didn't meet standards

RIPLEY — A woman is suing Seterus Inc., a home mortgage loan servicer, citing alleged fraud, misrepresentation and unconscionable conduct.

Cassia Kerns filed a complaint on July 18 in Jackson Circuit Court against Seterus Inc., alleging that the home mortgage loan servicer failed to comply with industry standards.

According to the complaint, the plaintiff alleges that she suffered economic loss, worry and distress, annoyance and inconvenience and fear of losing her home. The plaintiff holds Seterus Inc. responsible because the defendant allegedly directed its appointed trustee to proceed with a foreclosure sale, misrepresented the status of her loss mitigation application, misrepresented that she was secured in her home and failed to advise her of her appeal rights.

The plaintiff requests a trial by jury and seeks relief for maximum civill penalties for each violation, actual damages, attorneys' fees and costs and such other relief as the court deems just and equitable. She is represented by Loree Stark and Sarah K. Brown of Mountain State Justice Inc. in Charleston.
