Huntington resident accuses Speedway LLC of negligence

HUNTINGTON — A motorist is suing Speedway LLC, a gas station operator, citing alleged insufficient measures were taken to prevent injuries.

Donald Edgar Meadows filed a complaint on July 13, in the Cabell Circuit Court against Speedway LLC alleging that the gas station operator breached its duty to protect its customers.

According to the complaint, the plaintiff alleges that, in December 23, 2014, he was returning to his vehicle after paying the cashier inside the Speedway when he tripped over the protruding piece of metal at the base of the curb, hitting his head, hand, arms and left knee on the concrete, causing him to suffer pain and suffering, loss earnings, mental anguish and medical expenses. The plaintiff holds Speedway LLC responsible because the defendant allegedly failed to properly maintain its property.

The plaintiff requests a trial by jury and seeks judgment against defendant for all damages, together with statutory interest, costs expended for this action, attorney's fees and such other relief as the court may deem just and proper. He is represented by Shawn Baltram of Bellomy & Turner LC in Huntington.
