BECKLEY — An Indiana man is suing Mountain State Auto Auction Inc. and and auction employee Kathy Meadows, alleging that insufficient measures were taken to prevent injuries.
Luke Dermody filed a complaint on July 19 in Raleigh Circuit Court against the defendants, alleging that he was injured in a collision that was Meadows' fault.
According to the complaint, the plaintiff alleges that on Oct. 12, 2015, he was a passenger in a vehicle insured under an uninsured/underinsured motorist policy of State Farm Mutual Automobile Insurance Company. While traveling on 64W in Beaver, Meadows violently struck the rear of the vehicle in which he was riding, which caused him to sustain damages and permanent injuries to his head, back and psyche and to incur medical expenses, the suit alleges. The plaintiff holds Mountain State Auto Auction Inc. and Kathy Meadows responsible because Meadows allegedly failed to keep proper lookout, failed to maintain control of the vehicle and failed to avoid the accident, all while serving as an agent of the auction company.
The plaintiff requests a trial by jury and seeks judgment against the defendants, jointly and severally, for compensatory damages, pre- and post-judgment interest, attorneys' fees, costs and such other relief as the court deems just.
