Couple sues Mike Ferrell Ford-Lincoln for breach of contract

WILLIAMSON – A couple is suing Mike Ferrell Ford-Lincoln after they claim it breached its contract with them.

On April 8, 2015, Carol Brumfield and William Brumfield purchased a 2010 GMC Sierra 1500 with 88,414 miles on it from Mile Ferrell and traded in a 2005 Chevrolet Monte Carlo with 56,672 miles on it, according to a complaint filed July 15 in Mingo Circuit Court.

The Brumfields claim they purchased Easy Care as an additional coverage in the amount of $2,119 and the total amount financed by them was $26,603.

Approximately two weeks after purchasing the 2010 GMC Sierra, a representative from Mike Ferrell called and asked the plaintiffs to bring the vehicle into the garage and when they arrived, they were informed they needed to return the truck because they did not pass the credit check, according to the suit.

The Brumfields claim they asked Mike Ferrell to return the Monte Carlo and were informed it had already been sold. Mike Ferrell then offered to trade the plaintiffs an older model truck, with more miles on it, for the exchange of the GMC Sierra.

The plaintiffs did not want the older model truck and, on May 31, 2015, they received a letter from Capital One Auto Finance with their credit score, which was fair, and they have contacted Mike Ferrell on several occasions to try and resolve the problem with no success, according to the suit.

The Brumfields claim the defendant was negligent and caused the plaintiffs damages.

The defendant’s conduct was atrocious, intolerable and extreme so as to exceed the bounds of decency and Mike Ferrell breached its contract with the Brumfields, according to the suit.

The Brumfields are seeking compensatory and punitive damages with pre- and post-judgment interest. They are being represented by Justin J. Marcum of Marcum Law Offices PLLC.
