Contractor blames towing company for injuries

MOUNDSVILLE — A contractor is suing Herbert Carl Boso Jr. d/b/a Boso & Son Towing Service, alleging breach of duty and insufficient measures taken to prevent injuries.

Elmer Young filed a complaint on July 26 in Marshall Circuit Court against the defendant, alleging that the towing company failed to provide a safe place to work.

According to the complaint, the plaintiff alleges that on Aug. 10, 2014, he was on the defendant's premises working as a contractor when he sustained injuries due to an occurrence involving the use of a welding device. He suffered pain and suffering, emotional distress and mental anguish, lost wages and earning capacity and medical expenses, he claims. The plaintiff holds the defendant responsible because the towing company allegedly created and permitted a dangerous working condition.

The plaintiff requests a trial by jury and seeks judgment against the defendant for full compensation of his injuries and damages and whatever other relief would be appropriate.
