Fuel supplier says trucking company hasn't paid bills

LOGAN — A fuel supplier is suing Billy Hall d/b/a W&H Trucking, a trucking company, citing alleged failure to pay for purchased product and unjust enrichment.

Mountain State Petroleum Inc. filed a complaint on July 25 in Logan Circuit Court against Billy Hall d/b/a W&H Trucking, alleging that the trucking company failed to comply with their agreement.

According to the complaint, the plaintiff alleges that during May, June and July 2011, it supplied fuel to the defendant and issued invoices on a monthly basis. To date, plaintiff has suffered damages for not collecting payment for the fuel sold, plus finance charges in the total amount of $14,524.58, the suit alleges. The plaintiff holds the defendant responsible for allegedly failing to pay for amounts due and owing under the agreement.

The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of $14,524.58, plus costs and attorneys' fees, pre- and post-judgment interest and for any other relief as the court deems just and proper.
