HUNTINGTON — A customer is suing Wal-Mart Stores Inc., a retail store operator, citing alleged failure to warn and insufficient measures taken to prevent injuries.
Shirley Allen filed a complaint on July 19, in Cabell Circuit Court against Wal-Mart Stores Inc., alleging that the retail store operator negligently and carelessly maintained its consumer shopping area.
According to the complaint, the plaintiff alleges that on July 20, 2014, she sustained injuries after suffering a fall at defendant's retail store in Cabell County. She alleges the injuries have caused her extreme physical and mental pain and resulted in medical expenses. The plaintiff holds Wal-Mart Stores Inc. responsible because the defendant allegedly failed to take reasonable measures to inspect and maintain its floor in the area where consumers shop.
The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of the court's minimum jurisdictional limit, plus interest and costs and such other relief as the court may deem appropriate. She is represented by Matthew J. Woelfel of Woelfel & Woelfel LLP in Huntington.
