HUNTINGTON — An executor of a deceased woman's estate is suing the County Commission of Cabell County and Cabell County EMS, public corporations, citing alleged insufficient measures taken to prevent injuries.
Paul E. Davis, as executor of the estate of Virginia R. Davis, filed a complaint on July 25 in Cabell Circuit Court against the defendants, alleging that they deviated from the minimal applicable standard of care.
According to the complaint, the plaintiff alleges that as a result of the defendants' negligence, Virginia Davis sustained injuries when she struck a road surface, due to an ambulance gurney tipping over on July 27, 2014. Her injuries caused her to suffer great pain and mental anguish, loss of enjoyment of life, hospital and medical care and expenses through the date of her death on March 3, 2016, the suit alleges. The plaintiff holds the defendants responsible for an alleged failure to adequately secure Virginia Davis and to complete proper transport of her to a medical facility.
The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages, attorney's fees, pre- and post-judgment interest and such other relief as to which he is entitled. He is represented by Paul A Ryker of Paul A Ryker, Attorney at Law in Barboursville.
