Grandmother claims negligence led to grandson's death

CHARLESTON — A grandmother of a deceased grandson is suing Charleston Area Medical Center Inc., a health care provider, citing alleged breach of duty.

Nancy Lynn Hunt, administratrix of the estate of Jacob Tylor Brown, filed a complaint on Aug. 1 in Kanawha Circuit Court against Charleston Area Medical Center Inc., alleging that the health care provider failed to timely provide critical medical care to Dena Brown and Jacob Tylor Brown.

According to the complaint, the plaintiff alleges that Jacob Tylor Brown died on Jan. 5 as a result of the defendant's negligence, and that the plaintiff has suffered pain and suffering, mental anguish, loss of enjoyment of life, loss of companionship and became obligated to pay expenses for medical care and attention. The plaintiff holds Charleston Area Medical Center Inc. responsible because the defendant allegedly failed to properly admit Dena Brown for treatment of diabetes and failed to admit or refer her to an endocrinologist.

The plaintiff requests a trial by jury and seeks judgment against defendant for compensatory damages, punitive damages, pre- and post-judgment interest and such other relief as she may be entitled. She is represented by Stacy A. Jacques and Richard D. Lindsay of Tabor Lindsay & Associates in Charleston.
