Woman claims defamation, violation of constitutional rights

BLUEFIELD — A woman is suing Princeton Community Hospital, Bahavioral Health Pavillon, Dr. Kerry Musick, Anita Waid, Dr. Jeffry T. Gee and Jenny Stultz, health care providers, alleging fraud and defamation of character.

Etheloma Renee Perkins filed a complaint on July 28 in the U.S. District Court for the Southern District of West Virginia against the defendants alleging that they violated the Mental Health Bill of Rights.

According to the complaint, the plaintiff alleges that she suffered damages for not receiving her claim for her benefits under a worker's compensation policy and was subjected to cruel, unusual punishment and deliberate indifference to her serious medical needs. The plaintiff holds the defendants responsible because they allegedly destroyed her first OIC-WCI application for worker's compensation and she was required to sign a new one containing the signature of a doctor she hadn't met and including false information that was used to deny her claim.

The plaintiff requests a trial by jury and seeks compensation for damages in the amount of $1 million for each defendant and such other relief as the court may deem just.
