Woman blames junk company for garage-door injuries

BECKLEY — A woman is suing Barker Junk Company Inc., a business owner, alleging that insufficient measures were taken to prevent injuries.

Tammy Altice filed a complaint on July 28 in Raleigh Circuit Court against Barker Junk Company Inc., alleging that the business owner failed to keep its premises in a safe and reasonable condition.

According to the complaint, the plaintiff alleges that on Feb. 19, 2015, she was visiting the defendant's location with her boyfriend, who was conducting business with the defendant. While she was exiting the garage, the door fell and hit her on the head, face and shoulder. She incurred medical expenses, pain and suffering, scarring, emotional distress and inconvenience, she alleges. The plaintiff holds Barker Junk Company Inc. responsible because the defendant allegedly negligently lowered the garage door onto her, failed to maintain it in proper working order and failed to warn her of its dangerous condition.

The plaintiff requests a trial by jury and seeks an award for compensatory damages, attorney's fees, costs and any other relief the court deems just and proper. She is represented by Paul M. Stroebel of Stroebel & Johnson PLLC in Charleston.
