CHARLESTON — An man is suing Shamrock Villa Apartments LLC and John Doe, apartment owners, alleging that insufficient measures were taken to prevent injuries.
Russell Anderson filed a complaint on July 28, in the Kanawha Circuit Court against the defendants alleging that they breached their duty to protect him from being injured on their premises.
According to the complaint, the plaintiff alleges that, in August 1, 2014, he was walking on the property of defendants' complex when he slipped and fell on a wet and slick stairs causing him to suffer injuries that resulted in physical pain and suffering, loss of earning capacity, medical expense, mental anguish and emotional distress. The plaintiff holds Shamrock Villa Apartments LLC and John Doe responsible because the defendants allegedly negligently allowed the dangerous condition to exist, failed to make reasonable inspections to discover the hazardous condition and failed to eliminate such condition,.
The plaintiff requests a trial by jury and seeks judgment against defendants for compensatory damages in an amount sufficient to compensate him for his injuries, with pre- and post-judgment interest.
