BECKLEY — A motorist is suing Susan Clark and Denise Clark, two Raleigh County residents, alleging insufficient measures were taken to prevent injuries.
Richard Bower filed a complaint on Aug. 5 in Raleigh Circuit Court against the defendants, alleging that Denise Clark negligently entrusted her vehicle to Susan Clark.
According to the complaint, the plaintiff alleges that on Aug. 8, 2014, he was operating a 2013 Chevrolet Cruze, going south on Coal City Road in Raleigh County, while Susan Clark, with the permission of the owner Denise Clark, was operating a 2005 Nissan Altima and heading in the same direction when it rear-ended his vehicle. Plaintiff was caused to suffer personal injuries, pain and suffering, mental anguish, loss of enjoyment of life and medical expenses. The plaintiff holds Susan Clark and Denise Clark responsible because Susan Clark allegedly failed to exercise reasonable care to maintain control of the vehicle.
The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount to fairly compensate him for the injuries he sustained, plus attorney's fees and costs expended in this action. He is represented by Paul S. Perfater of Myers and Perfater in Charleston.
