Tenants accused of not paying lease

WINFIELD — A commercial real estate owner is suing Teays Urgent Care PLLC and Mohamad Samah Kalou a/k/a Sam Kalou, citing alleged breach of contract and unjust enrichment.

Four-S Development LLC filed a complaint on Aug. 5 in Putnam Circuit Court against the defendants, alleging that they failed to comply with a lease agreement.

According to the complaint, the plaintiff alleges that in November 2008 it entered into a lease agreement with the defendants until Dec. 31, 2016, for the lease of commercial real estate located in Liberty Square Shopping Center. As a result of the defendantss default in payment, the plaintiff sustained and continues to sustain economic harm and damages, the suit alleges. The plaintiff holds Teays Urgent Care PLLC and Mohamad Samah Kalou a/k/a Sam Kalou responsible because the defendants allegedly failed and refused to tender payments and unlawfully detained possession of the property at issue.

The plaintiff requests a trial by jury and seeks the eviction of the defendants and removal from possession of the subject property, compensation in the amount of $15,895.33, plus interest and late fees, attorney's fees and costs and any other relief that the court deems appropriate.
